The investigation was already transferred from a Telangana police Special Investigation Team to the CBI at the direction of a single Telangana High Court judge.

The Telangana government filed writ appeals in the High Court on Wednesday, January 4, challenging a single judge's decision to transfer the inquiry into the alleged attempt to abduct BRS MLAs from the Special Investigation Team (SIT) created by it to the CBI. On Thursday, the matter will be heard by a division bench of the High Court led by the Chief Justice. On December 26, 2022, a single judge of the High Court directed that the investigation into the suspected conspiracy to poach four BRS MLAs be transferred from the Telangana police Special Investigation Team (SIT) to the Central Bureau of Investigation (CBI).

The High Court also annulled the government's order to form the SIT and the investigation it conducted, as well as the initial investigation conducted by an Assistant Commissioner of Police. Ramachandra Bharati alias Satish Sharma, Nandu Kumar, and Simhayaji Swamy were already listed as suspects (A1 to A3) in the case when a complaint was filed against them on October 26, 2022, by BRS MLA Pilot Rohith Reddy. The trio was apprehended while reportedly attempting to entice four BRS MLAs to join the BJP. As a result, the High Court granted them bail. According to the FIR document, Rohith Reddy claimed that the accused promised him Rs 100 crore in exchange for leaving the TRS, now BRS, and running as a BJP candidate in the upcoming Assembly election. They allegedly instructed Rohith to attract additional BRS MLAs to the BJP by giving them Rs 50 crore each. On November 9, the Telangana government established a seven-member Special Investigation Team (SIT) to investigate the alleged attempt to poach the MLAs.
